In order to obtain a divorce order in Ontario, the court will require that there be:

 

  • an irreconcilable breakdown of the relationship; or
  • commission of adultery; or
  • perpetration of cruelty on the other

 

Additionally, courts will also require evidence of residency and evidence that reasonable arrangements have been made for the support of any children of the marriage.

When a divorce is granted or a marriage is declared a nullity, or when the spouses are separated and there is no reasonable prospect that they will resume cohabitation, the spouse whose net family property is the lesser of the two net family properties is entitled to one-half the difference between them.
